Q. I work in a hotel and I have heard of a new hotel
employment regulation order. What is this?

Employment Regulation Orders (EROs) regulate the pay and
conditions of employees in certain sectors. The Labour Court makes
an ERO confirming proposals submitted by a Joint Labour Committee (JLC).
The ERO is enforceable by law. Employers are obliged to pay the wage
rates and provide the conditions of employment prescribed by the ERO.
They must also display details of the current agreement in the
workplace and keep records of wages. A new ERO has come into effect
for the Hotel Industry on 16th September, 2009. This new ERO reduces
the Sunday Premium rate of pay from Double Time to Time and
One-third.
If an employee had previously been entitled to double time, they can
seek to remain on this rate. If an employer wishes to reduce the
Sunday premium under the new ERO, this amounts to a change in an
employee’s terms and conditions of employment. Any change to the
terms and conditions of employment should be agreed between the
employee and the employer in writing. An employee has the right to
information on the new ERO, and is not obliged to accept a reduction
in the Sunday premium.
The National Employment Rights Authority (NERA) is responsible for
enforcing EROs and, if necessary, will take proceedings against an
